With the FBI set to wrap up their investigation of potential security violations in the next months, is it possibly Clinton herself could face an indictment??
There are really two parts to this question. First, is there any evidence that Clinton or someone working for her violated the law..
Second, even if such evidence exists is it likely that the FBI will recommend prosecuting the front-runner for the Democratic nomination??
With regard to the first question, only the FBI knows whether there is any evidence of wrong doing, but it’s already not difficult to see where Clinton might be in trouble and where she probably is not.. Washington Post columnist Ruth Marcus wrote a piece arguing that Hillary Clinton was unlikely to face any charges in connection with the server. The first two-thirds of her argument seems to track with other reports, i.e. Clinton’s behavior isn’t as bad as General Petraeus because she didn’t lie to the FBI..
However, the last third of Marcus’ argument seems less convincing: Section 793(f) covers a person with access to “national defense” information who through “gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust”.. The argument here would be that Clinton engaged in such “gross negligence” by transferring information she knew or should have known was classified from its “proper place” onto her private server, or by sharing it with someone not authorized to receive it.. Yet, as the Supreme Court has said, “gross negligence” is a “nebulous” term. Especially in the criminal context, it would seem to require conduct more like throwing classified materials into a Dumpster than putting them on a private server that presumably had security protections..
Actually, what Clinton did is not all that dissimilar from accidentally throwing classified material in a gym bag and then hiding it in a garage. In this case, she may not have intended to have any classified information on her server but it did wind up there and once it did she failed to return that material to the government until, thanks to inquiries from Congress, the State Department came looking for it more than a year later..
And that brings us to the second question. Even if a case can be made for gross negligence, will the FBI apply the law fairly given that Hillary is leading in the race for the Democratic nomination and the wife of a former President, etc? The answer is still unclear but there is at least some concern that current FBI Director Comey is a little too independent to suit the Obama administration. A story published at The Hill is titled, “Comey’s FBI makes waves”.. The split over Clinton’s email server is the most politically charged issue facing the FBI, with nothing less than the race for the White House potentially at stake.. Obama has publicly defended Clinton, saying that while she “made a mistake” with her email setup, it was “not a situation in which America’s national security was endangered”.. But the FBI director has bristled at that statement, saying the president would not have any knowledge of the investigation.. Comey, meanwhile, told lawmakers last week that he is “very close, personally,” to the probe..
The article goes on to say that Comey’s reputation is one of speaking truth to power. So it seems within the realm of possibility that, if he believes prosecution of Clinton or her aides is warranted, Comey will pursue it regardless of consequences..
As anyone who has been following this story knows by now, any recommendation made by the FBI still has to be taken up by the DOJ. Former State Department Inspector General Howard J. Krongard told the New York Post in January that is very unlikely to happen: Still, “It will never get to an indictment,” Krongard said.. For one, he says, any criminal referral to the Justice Department from the FBI “will have to go through four loyal Democrat women” — Assistant Attorney General Leslie Caldwell, who heads the department’s criminal division; Deputy Attorney General Sally Yates; Attorney General Loretta Lynch; and top White House adviser Valerie Jarrett.. Even if they accept the referral, he says, the case quickly and quietly will be plea-bargained down to misdemeanors punishable by fines in a deal similar to the one Clinton’s lawyer, David Kendall, secured for Gen. David Petraeus. In other words, a big slap on the wrist..
Realistically then, the trail ends for Hillary at the DOJ. Even if FBI Director Comey speaks truth to power in this case, by suggesting there is evidence of gross negligence, Clinton will likely get the kind of special treatment reserved for "important" people...

The Vulture: How Billionaire Rubio Backer Paul Singer Made Billions off Argentina Debt Crisis

http://democracynow.org - Argentina has reached an agreement to pay U.S. hedge funds that have sought for 14 years to profit off the country’s debt. The hedge funds bought up Argentina’s debt for bargain prices after its financial crisis, then demanded full repayment. Former Argentine President Cristina Fernández de Kirchner had refused to pay the firms, calling them "vulture funds." But under new right-wing President Mauricio Macri, Argentina has agreed to pay $4.65 billion to four hedge funds, including Elliott Management, run by billionaire Paul Singer. The deal would see the hedge funds take about 75 percent of what they demanded from Argentina—several times more than what they actually paid for the debt. Singer’s fund itself netted $2.4 billion—10 to 15 times its original investment. We speak to journalist Greg Palast. US judge orders Iran to pay $10.5 Billion for 9/11 Attacks

 A US court has ruled that Iran must pay more than 10 billion dollars in damages to families of people killed in the September 2001 terrorist attacks.

A judge in New York issued the default judgment on Wednesday. George Daniels said Iran failed to defend itself against claims that it played a role in the attacks. The ruling is based on the 9/11 Commission Report which stated that some attackers moved through Iran and did not have their passports stamped. It also said Lebanon’s Hezbollah provided advice and training to Al-Qaeda members who carried out the attacks. Daniels had earlier cleared Saudi Arabia from culpability. The allegations come as fifteen of the 19 attackers were Saudi citizens and none were Iranian. The September 11 raids were a series of four coordinated terrorist attacks by Al-Qaeda.

The now-common violent outbreaks at Donald Trump rallies escalated further at an event in Fayetteville, North Carolina on Wednesday. Footage that surfaced Thursday morning showed a black man getting punched in the face by a white rally attendee and then wrestled to the ground by police officers. The protesters were being led out of the rally by men who were wearing sheriff’s uniforms when Rakeem Jones flipped his middle fingers to the crowd. In the video, he’s punched in the face by a white man in a cowboy hat. The crowd cheers, and Jones is pushed to the ground by the officers and handcuffed. Jones, who says he and a group of friends went to the rally as a “social experiment,” told the Washington Post that while he was handcuffed and detained, the man who attacked him was allowed to stay. “It’s happening at all these rallies now and they’re letting it ride,” he said. “The police jumped on me like I was the one swinging.” An Instagram video taken by one of Jones’ friends shows the officer tackle and handcuff him: Protesters at prior Trump rallies have been dragged, kicked, beaten, choked, and shoved to the ground. Trump himself has failed to condemn his more violent supporters. Instead, he’s invited them on stage to be publicly honored for beating up a high schooler, argued a Black Lives Matter protester deserved to be roughed up, and told a crowd that he wished he could punch a protester at a Nevada rally in the face. “You know what they used to do to guys like that when they were in a place like this? They’d be carried out on a stretcher,” he said at the time. Gossip site TMZ identified the man as 78-year-old John McGraw. According to TMZ, he's facing charges for assault and disorderly conduct.

The rule was originally put in place by President Bill Clinton, but has been waived since the economic crash in 2007. BIOMETRIC FACIAL RECOGNITION AT U.S. BORDER - New Big Brother Tech Being Tested For Nationwide Use! 

The federal government is using eye scans and facial recognition technology for the first time to verify the identities of foreigners leaving the United States on foot — a trial move aimed at closing a longstanding security gap, officials announced Thursday.

Before now, foreigners who left the country were rarely checked by U.S. authorities as they walked into Mexico or Canada through ports of entry.

The checkout system that launched Feb. 11 at a busy San Diego border crossing with Mexico aims to ensure those who enter the country leave when their visas expire and identify those who violate that. Up to half of the people in the U.S. illegally are believed to have overstayed their visas.

Border officials in December started collecting the same information on non-citizens walking into the U.S. through the Otay Mesa crossing connecting Tijuana and San Diego.

Congress has long demanded biometric screening like fingerprints, facial images or eye scans from people leaving the country, but the task has posed enormous financial and logistical challenges at busy land crossings. Privacy advocates worry the data could be misused or fall into the wrong hands.

Visa is beginning a proof of concept trial in South Africa to test a payments specification that uses biometrics to verify chip card transactions. Absa Bank, a subsidiary of Barclays Africa Group, intends to use the specification on fingerprint readers at selected ATMs in lieu of a PIN.

The specification can enable palm, voice, iris or facial biometrics, according to Visa. With fingerprints, for example, the technology allows a fingerprint to be securely accepted by a biometric reader, encrypted, and then validated. The technology framework is designed to work with the Europay, MasterCard, Visa (EMV) chip standard to ensure global interoperability. Which means that although the trial is limited to South Africa, where Visa is admirably focused on providing the population easier access to banking, it could eventually expand to other regions where EMV is supported. And as we all know, the US migration to EMV standards is right around the corner. However, Visa did not make any expansion plans immediately clear.

"There is increasing demand for biometrics as a more convenient and secure alternative to signatures or PINs, especially as biometrics technologies have become more reliable and available," said Mark Nelsen, SVP of Risk Products and BI for Visa, in a statement. "However, to support wide adoption, it is equally important that solutions are scalable and based on open standards. Building on the EMV chip standard provides a common, interoperable foundation, as well as encourages innovation in cutting-edge biometric solutions."

For now it seems as though use cases for the specification are limited to just chip-enabled ATMs, but it's not hard to imagine biometrics eventually trumping PINs at the point of sale.

Visa said it plans to offer the technology to EMVCo, the global technical organization that manages the EMV Specifications, to further develop and administer the standard.
