How about the sheriff put himself in Guererro's position?! If a homeowner felt threatened by unidentified people lurking on his property, he could shoot them and claim "in fear of his life." Of course, if it is an old man shot, no problem, but shooting a cop who failed to identify himself probably would not bode well for a defensive homeowner, because cops are a protected class and only they can shoot with impunity.
