Judge Napolitano on CVS Policy Forcing Employees to Turn Over Health Info: Consequence of ObamaCare
3/21/13 - Appearing on America's Newsroom this morning, Fox News senior judicial analyst Judge Andrew Napolitano took on the controversial CVS policy of forcing its employees to submit personal health information as part of receiving health insurance coverage from the company. The outspoken libertarian posited that the unpopular mandate is a consequence of federal micromanagement of health-care through ObamaCare.
The largest retail pharmacy chain in the country is now requiring its employees to hand over personal health information like their weight, body mass index, and glucose levels or face an annual fine of $600. The company says it is requiring this as a way to ensure their employees are as healthy as possible.
Napolitano told host Martha MacCallum of the policy: "I think this is a consequence of the federal government micromanaging health care and forcing employers to provide coverage to all employees, many who otherwise wouldn't qualify for it, and forcing them to provide coverage, whether the employees need it or not."
The judge noted that under federal law, CVS has an interest in hiring only healthy employees in order to save money now that they are forced to cover all of their workers. "So will ObamaCare result in larger people with larger body mass and higher glucose levels not getting employed? Would that be an unintended consequence of ObamaCare?" he suggested.
He later explained that the policy is "so expensive because ObamaCare has a one-size-fits-all," meaning people cannot tailor an insurance policy to met their individual needs. "We knew that was coming but I don't think we realized — even those of us who didn't read all 2700 pages but have a good understanding what is in there — we didn't realize the economic effect of people not being able to get jobs because they're overweight. Maybe judges will have to decide what is obese? Is it 10 pounds heavier than your height? Is it 20 pounds? Is it 50 pounds?" he added.
MacCallum pointed out that CVS defends itself by noting that 79-percent of other companies have a "health assessment" policy in place. "The fine clearly helps to pass along the cost of ObamaCare to the employee, right?" she asked.
"Absolutely," the judge replied. "Because contrary to what the president said, these insurance policies will cost more than the coverage you had before the federal micromanagement."

Obama: If Syria used chemical weapons, it's a "game changer"
The next question is about differences between Obama and Netanyahu on their approach to Iran.
At a joint press conference with Obama at the Prime Minister's Office following a lengthy meeting, Netanyahu said that with the entry of the new government, "Israel remains fully committed to peace and a solution for two states for two people."
"We extend our hands in peace and friendship to the Palestinians... let us put aside all preconditions and work together to achieve a historic compromise and put an end to the conflict," the prime minister said.
Netanyahu also emphasized that Israel "cannot cede the right to defend ourselves to others," hinting at a possible go-it-alone plan to attack Iran's nuclear program.
Addressing the same issue, Obama said he prefers to deal with the Iranian nuclear threat in a "diplomatic" manner.
He insisted that "all options remain on the table" and added that a "nuclear armed Iran would be threat to region, the world, and an existential threat to Israel."
As much as Obama prefers a diplomatic solution, he added that "Iran's leader must understand they must meet international obligations."
"I can say with confidence that Israel's security is guaranteed, and its got a great deal on its side," he said.
Obama also emphasized that the US government would continue to fund the Iron Dome missile defense system.
Obama stressed that Americas commitment to the State of Israel is a "solid obligation" and one that is "non negotiable."
"I will ensure no interruption in funding of the Iron Dome," said Obama. He added that his government would be providing $200 million this fiscal year, and would continue to work with congress to provide support for Israel. He added that the central element of lasting peace in Israel is a "strong and secure Jewish state."
Turning to Syria, Obama said that the United States was investigating whether chemical weapons had been used in Syria, and that Syrian President Bashar Assad would be held accountable if they had been.

Cyprus Banks To Remain Closed All Week Amid Crisis
Banks in Cyprus will remain closed on Thursday and Friday while the country scrambles to find a way to secure bailout funds after rejecting a levy on all savings. With Monday a public holiday, the move effectively closes lenders until Tuesday, March 26. The finance ministry said the decision had been taken "on grounds of public interest in order to ensure financial stability". Banks have already been closed since last Saturday as Cyprus seeks to prevent the uncertainty prompting a run on them. While money is still available from cash machines, the lack of liquidity in the market has seen petrol stations close their credit card facilities and many stores refuse to accept cheques. Cyprus' cabinet went into emergency session on Wednesday after voting against the tax on all savings, which was originally agreed with international lenders to secure a 10bn euro (£8.6bn) bailout package. The acting leader of the ruling Disy party, Averof Neophytou, said ministers planned to meet late into the night. "We will not sleep tonight until we find a solution ... I am confident we will find a solution so we do not go bankrupt," he said. State radio said legislation had been drafted to restrict the outflow of cash from the island once the banks reopen. These would need to be passed by the cabinet and by parliament. The troika of the European Union, European Central Bank and International Monetary Fund said it would only provide Cyprus with the bailout if it raised 5.8bn euros through the levy. Local media reported the government was considering raising money from domestic sources including provident funds, and restructuring the teetering banking sector in order to meet the shortfall. However, Cypriot officials were unable to agree a deal to secure funding from one alternative source after talks in Moscow failed to secure any assistance. Finance minister Michael Sarris went to Russia asking for a five-year extension on a 2.5bn euro loan granted in December 2011 that is due to mature in 2016 and lend an additional 5bn euro. Russian Prime Minister Dmitry Medvedev has called the bailout bungled, but said a solution should not damage Russia's relations with the EU. "It seems to me that every mistake possible in this situation has been made," he was quoted as saying by the Interfax news agency. Russians reportedly hold up to half of all Cypriot deposits.

Lindsey Williams on His Cancer Treatment in Mexico
Lindsey Williams, who has been an ordained Baptist minister for 28 years, went to Alaska in 1971 as a missionary. BREAKING: Cyprus Parliament unanimously rejects EU bailout. March 19th 2013
Cyprus' parliament has rejected a controversial levy on bank deposits, proposed as part of an EU-IMF 10bn-euro (£8.7bn; $13bn) bailout package.
No MPs voted for the bill, with 36 voting against and 19 abstaining.
The finance ministry had modified the package, proposing an exemption for savers with smaller deposits, but opposition had remained fierce.
Thousands of protesters who had filled the streets outside parliament reacted with joy to the news of the vote.
EU finance ministers have warned that Cyprus' two biggest banks will collapse if the deal does not go through in some form.
However, there has been widespread outrage on the island at the prospect of ordinary savers being forced to pay a levy of 6.75%
The plan was changed to exempt savers with less than 20,000 euros (£17,000), with those over 100,000 euros charged at 9.9%, but this was not enough to placate critics.

Meanwhile, the UK ministry of defence said a plane carrying 1m euros was heading to Cyprus as a contingency measure to provide military personnel and their families with emergency loans.

Masters believes that an "object of interest" captured in webcam photos of the Turrialba Volcano in Costa Rica is possibly a harbinger to the arrival of Planet X. He nicknamed the object "Bluebonnet" because of its bluish color and said that it appears before sunset near the ecliptic of the sun. Bluebonnet, he reported, may be planet-sized but can only be observed from high altitudes above the cloud cover during certain times of the day, such as sunset.
